The agreement
These Terms of Service ("Terms") govern your use of nxgrowthpartner.com and its landing pages (the "Site"), operated by NX Growth Partner ("NX Growth Partner", "we", "us"). By using the Site, submitting a form or booking a call, you agree to these Terms and to our Privacy Policy. Last updated October 15, 2026.
The Services themselves are governed by a separate written agreement. Nothing on the Site is an offer that becomes a contract by itself. The scope, price, term, guarantee details and territory for any engagement are set out in the Services Agreement we sign with you, and if these Terms and that agreement conflict, the agreement wins.
What we offer
NX Growth Partner provides advertising, lead response and appointment-setting services to home energy contractors (HVAC, solar, insulation and similar trades). In outline: we run ads under your company's name, respond to the inquiries they generate, qualify homeowners against agreed checks, and book home visits into your calendar. The Site describes the system in general terms; your Services Agreement describes what we will do for you.
You must be a business (or acting for one) to use the Services. You confirm that the person submitting a form or signing an agreement is authorised to do so.
Territory checks and availability
A "territory check" on the Site tells you whether, at that moment, we have an existing client in your trade covering the area you entered. It is not a reservation. A territory is only yours once a Services Agreement naming it has been signed by both sides. We may decline any engagement, including after a call, for any lawful reason.
The guarantee
Where a Services Agreement includes our performance guarantee, it works as described there. In general terms: we agree with you, before you start, a number of booked home visits for your first 30 days; if we miss that number, we continue working at no further service fee until it is reached. It is a service guarantee, not a refund, and it depends on the conditions in the agreement, which typically include: approvals returned within five business days, your photos and brand assets supplied, the agreed advertising budget funded and kept running, appointments attended by your team, and your calendar kept open to the capacity you told us you have.
A "booked home visit" means a homeowner who has answered the agreed qualifying checks, chosen a time, and been confirmed. We do not guarantee that any home visit turns into a quote, a sale or an install, or any level of revenue or profit. Results described on the Site are from past work and are not a promise of yours.
Fees and payment
Fees, advertising budgets, billing dates and the term of the engagement are set out in the Services Agreement. Advertising budgets are paid to the advertising platforms and are separate from our service fee. Late payments may pause the Services and accrue interest at the rate stated in the agreement or the highest rate the law allows, whichever is lower.
Your responsibilities
- Give us accurate information about your business, trades, service area, licences and capacity, and tell us when it changes.
- Hold the licences, insurance and permits your trade and state require, and comply with the laws that apply to your business, including consumer protection, home-improvement contracting and advertising rules in your state.
- Review and approve ads, pages and messages we prepare under your name within the time agreed. Once approved, you are responsible for the claims about your business they contain.
- Attend booked home visits, or tell us in good time if you cannot, and treat homeowners' information in line with your own privacy obligations.
- Not use the Site or Services for anything unlawful, to send unsolicited messages, or to interfere with our systems.
Intellectual property and your brand
The Site, its design, text, images, videos, the name "NX Growth Partner" and the "Booked-Install System" are ours or our licensors' and are protected by copyright and trademark law. You may view the Site for your own business use and may not copy, scrape or republish it.
You give us a licence to use your company name, logo, photos and other brand assets to prepare and run campaigns for you during the engagement. You keep ownership of your brand. We keep ownership of our methods, templates, ad frameworks, message sequences and software, including improvements made while working for you. The Services Agreement states who owns ad accounts, landing pages, lead data and reporting at the end of the engagement.
Communications
By giving us your phone number or email you agree we may contact you about your enquiry and, if you become a client, about the Services, including by automated text message as described in our Privacy Policy. Reply STOP to any text to opt out. Calls may be recorded for training and quality where the law allows and you are told at the start of the call.
Disclaimers
The Site and its content are provided "as is". We make no warranties, express or implied, about the Site, including that it will be uninterrupted or error-free, or about the accuracy of statistics, examples and descriptions on it, which are illustrative. Example ads shown on the Site are illustrations, not live campaigns. Quotes attributed to contractors are from our calls, lightly edited for length, with names withheld. Nothing on the Site is legal, financial or tax advice.
Limitation of liability
To the fullest extent the law allows, NX Growth Partner and its founders, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or business, arising from the Site or Services, even if advised of the possibility. Our total liability for any claim relating to the Site or Services is limited to the service fees you paid us in the three months before the claim arose, or $500 if you have paid none. Some states do not allow some of these limits, so some may not apply to you.
Indemnity
You will defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or the Services Agreement, the claims and content you approve for use under your name, your dealings with homeowners, or your breach of law.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Before starting any formal proceeding, each side agrees to write to the other describing the dispute and to spend 30 days trying to resolve it. Disputes that are not resolved will be brought in the state or federal courts located in Delaware, and both sides consent to their jurisdiction, except that either side may seek an injunction to protect intellectual property anywhere. Each side waives any right to a jury trial and to bring or join a class action, to the extent the law allows.
General
These Terms, the Privacy Policy and any Services Agreement are the whole agreement between us about their subject. If part of these Terms is unenforceable, the rest still applies. Our not enforcing a term is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor of the business. We may update these Terms by posting a new version on the Site with a new date; the version in force when you use the Site applies.
